1. Parties
These terms apply to the services of many styles and forms (hereinafter: YourSoundTrack), based in the Netherlands, Chamber of Commerce number [INVULLEN], and the customer placing an order through yoursoundtrack.com (hereinafter: Customer).
2. The service
YourSoundTrack generates custom instrumental background music based on a brief submitted by the Customer. After successful payment, the Customer receives the generated music as a digital download (MP3 and WAV) and via a private SoundCloud playlist. Delivery follows the selected package target: same business day, within 24 hours, or within 48 hours.
3. Payment
Payment is made as a one-time upfront charge via Stripe. Prices include VAT unless stated otherwise. YourSoundTrack reserves the right to adjust prices; the price in effect at the moment of ordering is binding.
4. Delivery and delivery time
YourSoundTrack aims to deliver according to the selected package target. In exceptional cases such as technical issues or unusually high demand, delivery may take longer. YourSoundTrack informs the Customer by email as soon as the set is ready and support reviews delivery issues case by case.
5. Right of withdrawal
Because YourSoundTrack provides digital content that is generated immediately after payment based on the Customer's specific brief, the statutory right of withdrawal lapses once generation has started, pursuant to Article 6:230p sub f of the Dutch Civil Code. The Customer expressly agrees to performance starting before the withdrawal period ends and acknowledges that the right of withdrawal therefore lapses.
6. Refunds
YourSoundTrack applies a reasonable refund policy. A refund may be granted if: (a) the generated music demonstrably does not match the submitted brief, or (b) delivery occurs significantly later than 2 hours after payment without valid reason. Refund requests must be submitted to contact@getyoursoundtrack.com within 7 days after delivery.
7. License
Upon delivery, the Customer receives a perpetual, non-exclusive commercial license as described on the License page. The license terms form an integral part of these Terms of Service.
8. Liability
YourSoundTrack's liability is limited to the amount paid by the Customer for the relevant order. YourSoundTrack is not liable for indirect damage, consequential damage, or lost profits. For commercial use as described in the License, the delivered music is free of third-party PRO and copyright claims, and YourSoundTrack stands behind that position.
9. Governing law
These terms are governed by Dutch law. Disputes shall be submitted to the competent court in the Netherlands.
