1. Parties
These terms apply to the services of many styles and forms (hereinafter: YourSoundTrack), based in the Netherlands, Chamber of Commerce number 96741082, VAT number NL005231145B76, and the customer placing an order through getyoursoundtrack.com (hereinafter: Customer).
2. The service
YourSoundTrack generates custom instrumental background music based on a brief submitted by the Customer. After successful payment, the Customer receives the generated music as a digital download (MP3 and WAV) and via a private SoundCloud playlist. Delivery follows within 24 hours after payment and a complete brief.
3. Payment
Payment is made as a one-time upfront charge via Stripe. Prices are shown excluding VAT unless explicitly stated otherwise; VAT or other applicable tax is calculated at checkout where required. YourSoundTrack reserves the right to adjust prices; the price in effect at the moment of ordering is binding.
4. Delivery and delivery time
YourSoundTrack aims to deliver according to the selected package target. In exceptional cases such as technical issues or unusually high demand, delivery may take longer. YourSoundTrack informs the Customer by email as soon as the set is ready and support reviews delivery issues case by case.
5. Right of withdrawal
Because YourSoundTrack provides digital content that is generated immediately after payment based on the Customer's specific brief, the statutory right of withdrawal lapses once generation has started, pursuant to Article 6:230p sub f of the Dutch Civil Code. The Customer expressly agrees to performance starting before the withdrawal period ends and acknowledges that the right of withdrawal therefore lapses.
6. Refunds
YourSoundTrack applies a reasonable refund policy. A refund may be granted if: (a) the generated music demonstrably does not match the submitted brief, or (b) delivery occurs significantly later than the stated 24-hour delivery target without valid reason. Refund requests must be submitted to contact@getyoursoundtrack.com within 7 days after delivery.
7. License
Upon delivery, the Customer receives a perpetual, non-exclusive commercial license as described on the License page. The license terms form an integral part of these Terms of Service.
8. Liability
YourSoundTrack's liability is limited to the amount paid by the Customer for the relevant order. YourSoundTrack is not liable for indirect damage, consequential damage, lost profits, third-party playback enforcement, or territory-specific collecting-society obligations outside the direct licence scope described on the License page.
9. Governing law
These terms are governed by Dutch law. Disputes shall be submitted to the competent court in the Netherlands.
